An important aspect of the excellent new investigative piece by the Wall St J is about to be overlooked. This part establishes that Trump committed a felony when he knowingly omitted his debt to Michael Cohen from his June 2017 financial disclosure report. 

CREW (@CREWcrew) filed a complaint about this criminal violation with the Department of Justice earlier this year. 

Adav Noti (@AdavNoti) and I also sounded the alarm earlier this year about Trump’s failure to disclose his debt to Cohen. 

Here is one of the criminal laws Trump has violated. It’s part of the Ethics in Government Act of 1978. 5 U.S.C. app. § 104.

Here is another criminal law that Trump has violated. 18 U.S.C. § 1001

The new reporting by WSJ establishes that Trump knew of his debt to Cohen. Trump’s signature establishes that he knew he had omitted that debt from his financial disclosure report.

This should also bring new attention to the effort by Trump’s attorney to persuade OGE to allow Trump to be the first public financial disclosure filer in history not to be required to attest that his financial disclosure report was true by signing it. 

Worth noting, too, that the financial disclosure Trump filed in 2018 admits the debt to Cohen was a personal debt he repaid himself. This forecloses speculation that the Trump Org. paid, unless he committed a felony false statement by lying about having paid. Felony either way.
