BREAKING: Sarah Palin's defamation suit against the New York Times has been revived by the Second Circuit, on procedural grounds.

Context: This wasn't entirely unexpected.

Judge Rakoff held an evidentiary hearing two years ago to learn about the editorial decisions that led to the op-ed at issue.

This is unusual for before a motion to dismiss, where facts are assumed.

That's what troubled the 2nd Cir.

Needless to say, this is a bad time for the New York Times to lose support from their subscribers.
