Big: The 2nd Circ revives a case filed by the Federal Defenders over the BOP's suspension of attorney visits at MDC in 2019.

They urge the judge "in the strong possible terms" to quickly appoint a master to adopt procedures for emergencies, like #Covid19.

Some background here:

MDC, a federal prison in Brooklyn, suffered an institutional breakdown after a fire caused a blackout in January 2019, leading to a lockdown resulting in harrowing court hearings.

This is my coverage of it from last year.

A year and a new emergency later, another federal prison across the river, MCC, recently had a lockdown over intel that a gun was smuggled inside. Authorities did find a loaded gun, as worried families and counsel could not reach inmates during the Covid-19 outbreak. (cont'd)

Meanwhile, the Federal Defenders of New York's appeal of their lawsuit over the 2019 lockdown snaked through the Second Circuit, which seemed ready to recommend mediation last February. c/o, my colleague @amandaottaway

The national emergency may have changed their course.

The 28-page opinion reviving the case and urging a special master's appointment is remarkable to read in full, but check out the conclusion starting on page 25. </thread>
